Terms of Service

Every charter is governed by a standard MYBA Charter Agreement, which clearly outlines the terms for the protection of both the charterer and the yacht owner. These terms explain how we work alongside it.

How A Charter Is Agreed And Run

Our role

Luxury Yacht Charter Bali, operated by Bali Premium Trip, arranges and manages private charters aboard vessels we have vetted. For each charter we act as the charter manager: we present the vessels, issue the proposal, prepare the agreement, coordinate provisioning and logistics, and remain your point of contact throughout. The vessel itself is operated by its owner and master.

The charter agreement

Once you have selected a yacht, we issue a standard MYBA (The Worldwide Yachting Association) Charter Agreement. This contract clearly outlines the terms of the charter for the protection of both the charterer and the yacht owner. Where anything in these website terms conflicts with your signed charter agreement, the charter agreement prevails.

Payment schedule

A deposit of 50% of the charter fee is required upon signing to secure the booking. The final balance, plus the Advanced Provisioning Allowance, is typically due 30 days prior to embarkation. For some charter types a 25-50% deposit applies with the balance due 60-90 days prior to departure; your proposal states which schedule applies to you. We accept payment by international wire transfer or major credit card, the latter subject to a 3% processing fee.

The Advanced Provisioning Allowance (APA)

The APA is an advance payment, typically 30-35% of the charter fee, held to cover variable expenses such as fuel, food, beverages, port fees and any specific requests. The captain maintains a running tally of all expenditures, which is available for your review at any time. A full account is presented at the end of the charter. Any unspent funds are returned to you directly; if expenses exceed the APA, the difference is settled prior to disembarkation.

Taxes, fees and gratuities

A Value Added Tax of 11% is applied to most charter services. Port fees, national park entrance fees and local community levies are charged per person or per yacht depending on the itinerary; entry to Komodo National Park, for example, carries a daily fee for both the yacht and each guest. Crew gratuity is discretionary and is not included in any quoted rate; the industry convention, as recommended by MYBA, is 10% to 15% of the charter fee, presented to the captain at the conclusion of the charter for distribution among the crew.

Rates and quotations

Charter rates shown across this site are indicative and subject to season, duration and itinerary. They are a starting point for a conversation, not an offer. A formal, itemised quotation is issued with every charter proposal and is the only figure on which you should rely.

The captain’s authority

The captain’s primary responsibility is the safety of all on board, and their authority on matters of navigation and vessel operation is absolute. The final route is always subject to your wishes in consultation with the captain, who will advise on feasibility based on weather, sea conditions and travel times. The captain may alter or curtail an itinerary where safety requires it, and may decline a request that would breach maritime regulation, marine park rules or published wildlife distances.

Guest capacity and conduct

Each vessel has a maximum guest capacity which cannot be exceeded, for safety and comfort reasons. Minimum guest numbers apply on some vessels. Guests are asked to follow the crew’s safety briefings and instructions at all times. Some yachts require adult supervision for children or set minimum age requirements; your proposal will state any that apply.

Insurance

Each vessel carries Hull and Machinery insurance and Protection & Indemnity third-party liability cover, with P&I limits consistently set at a minimum of $10 million. This covers incidents directly related to the yacht’s operation. We strongly advise guests to secure their own comprehensive travel insurance covering medical emergencies, trip cancellation or interruption, and personal effects.

Governing law

These terms, and any charter arranged under them, are governed by the laws of the Republic of Indonesia, without prejudice to the dispute provisions of your signed MYBA charter agreement.

Questions

Ask Before You Sign

We would rather answer a question now than have you discover an answer later. Ask the desk anything about the agreement, the schedule or the APA.
